Is there a due date for Menards Plaint Form ?
I've been hearing from multiple sources that the deadline in the MFB's “Notice of Filing” is August 28th. This is based on my assumption that the MFB will submit an FFAP Form, and it will be approved either before or right after that. It is assumed that if there's a lawsuit filed before the due date, the MFB will request depositions and get depositions in order to get the suit tossed. My question is how long does it take the MFB to file a suit and actually get to trial? I read that in the MFB's “Notice of Filing” it shows how many Fps they have filed, so I'm assuming the MFB hasn't filed the suit yet. I read a number of other articles claiming the MFB has the right to file the suit after the MFB filing deadline, but I'm not sure how this applies. The only information I've seen is about the fact that the deadline is August 28th, so does that mean the deadline for filing the suit is August 28th, or is there another filing deadline as I read elsewhere? If the deadline for filing the suit is September 5th, will there be enough time for depositions, and for the other party (Menard Plaint) to respond to that reply? Thanks! I am trying to figure out the due date of Menard plaintiffs (if such lawsuit exists) in the pending case. The current case is Menard v. C.V. Smith. Since the first court date from Menard is scheduled for June 12, a reasonable assumption would be that they are filing the complaint by mid-May. The complaint has been filed. The case is still in discovery. I don't know how Menard Plaints will respond to the initial response, and what the case looks like at that moment. But given Menard plaintiffs' past actions and what is probably an aggressive legal strategy, we are probably looking at a lawsuit as soon as September. We don't know anything about the Menard Plaints strategy, how they will respond, how long it will take them to respond, etc.
